Representatives for the EU and UK required by Article 27 GDPR
Article 27 of the GDPR requires organizations that offer goods or services or monitor the behaviour of EU residents to have a representative within at least one EU member state. If your organization does not have an establishment in the EU, but still processes data of EU residents, you are obliged to appoint an EU representative.
Sinds het Verenigd Koninkrijk op 1 januari 2021 de EU heeft verlaten, geldt nu een soortgelijke vertegenwoordigingsplicht. Als u goederen of diensten aanbiedt of het gedrag van inwoners van het VK volgt, terwijl u geen fysieke vestiging in het VK hebt, moet u dus een AVG-vertegenwoordiger in het VK aanwijzen.

Waar dient een EU-vertegenwoordiger te zijn gevestigd?
Als een organisatie persoonsgegevens verwerkt van betrokkenen die in een beperkt aantal EU-staten wonen, moet haar vertegenwoordiger in één van die staten gevestigd zijn.
Wij adviseren om een EU-vertegenwoordiger aan te stellen in het EU-land waar u de meeste persoonsgegevens verwerkt. U zult waarschijnlijk de meeste aanvragen en verzoeken uit deze lidstaat ontvangen. Een AVG-vertegenwoordiger in deze lidstaat, die verzoeken in de eigen taal behandelt, zal de communicatie dan ook veel gemakkelijker maken.

How does the service work?
Our GDPR representation service begins with an initial onboarding process, followed by an ongoing monitoring and reporting service.
Initial onboarding
During the onboarding phase, we will review your privacy policy and ensure that appropriate contact information is available for your representative. This data must be clearly visible and accessible to data subjects and supervisors who want to contact you.
Your representative must keep a copy of your Processing Register details. We will therefore check or help you establish your existing Processing Register for your processing activities in the EU and the UK. We use this data to respond to requests from data subjects or questions from supervisors.
Ensuring continued compliance
Once we have recorded your processing register, it will be maintained and updated regularly. We will receive, assess and, where necessary, respond or translate requests from data subjects and regulatory authorities. We can also help you provide the right responses. Our representation service also includes access to our telephone advice service and regular information and advice on data protection issues that may affect your activities.
Local GDPR Representation in the UK and the 27 EU Member States
Our network of offices across the UK and Europe gives you a physical address, local telephone number and email address in your chosen country.
For example, if you are a UK organization offering goods or services to residents of France, but you do not have a physical presence in France, we will provide your representation service from our office in Paris, France. In your privacy policy you can then publish our French address, French telephone number (answered in French and English), and email address.
For the correspondence we receive from data subjects in other languages, we use a professional online translation service that allows us to receive requests in English and then respond to the data subject in their own language via this service.
These services allow us to deliver seamless GDPR representation in the UK and EU in all world languages.
